Terms and conditions of use
The rules for access to www.rubycat.eu (hereinafter the “Site”) and its conditions of use are subject to the User’s unreserved acceptance, solely by virtue of their browsing on the Site, of these Terms and Conditions of Use (hereinafter the “Terms”), which include our Confidentiality and Cookie Usage Policy.
Please note that these Terms may be amended or supplemented at any time by Rubycat, in particular to comply with any legislative, regulatory, jurisprudential or technological changes. In such cases, the update date will be clearly shown at the start of these Terms. These modifications are binding on the User as soon as they are put online. The User is therefore advised to regularly consult these Terms to identify any changes.
1. Conditions of use
The Site accessible at the following URL: www.rubycat.eu is operated in compliance with French legislation. The use of this site is governed by these Terms. By connecting to and using the Site, you acknowledge that you have read these terms, you are deemed to have accepted them without reservation and you undertake to comply with them.
2. User information
As a User of the Site, regardless of your quality (professional or private), your location, your terminal for connecting to the Site and the purpose of your visit, you are informed of the risks inherent to the Internet, in particular the risks of unsecured continuity in access to the Site.
It is your responsibility to take all necessary precautions to ensure that the Site you choose to use or the information published and which you access is not tainted with errors or even elements of a destructive nature such as viruses, trojans, etc.. Rubycat shall not be held liable in any way for any difficulty in accessing the Site or for any misuse of it in breach of these Terms.

If you notice a gap, error or what seems to be a malfunction, please report it to us through our contact form, describing the problem as precisely as possible (page causing the problem, triggering action, type of computer and browser used, etc.).
3. Intellectual property
All content on this Site, including, but not limited to, graphics, images, text, videos, animations, sounds, logos, gifs and icons as well as their formatting, is the exclusive property of Rubycat, with the exception of trademarks, logos or content belonging to other partner companies or authors.
Any reproduction, distribution, modification, adaptation, retransmission or publication, even partial, of these various elements is strictly prohibited without the express written consent of Rubycat. Any representation or reproduction, by any means whatsoever, without the express written consent of Rubycat, constitutes an infringement punishable by articles L.335-2 and following of the Intellectual Property Code. As the owner of the copied content, Rubycat could engage the civil and criminal liability of the infringer.
Rubycat is also owner of the “database producers’ rights” referred to in Book III, Title IV, of the Intellectual Property Code (law n° 98-536 dated 1 July 1998) relating to copyright and databases.
TRADEMARK
RUBYCAT is a registered trademark protected in France and abroad.
Unless expressly authorised in advance, any reproduction or representation, in any form whatsoever, of this trademark as well as any other visual trademarks, figurative or not, belonging to Rubycat or third parties exposes the User to criminal and civil proceedings.
The User undertakes not to delete, modify, change or remove in any way whatsoever the Rubycat trademark and, more generally, any mention of ownership affixed by Rubycat to any of the elements of the Site.
HYPERLINKS
Hypertext links set up by the User redirecting to the Site
Users and visitors of the Rubycat Site may not set up a hyperlink to this Site without the express prior authorisation of Rubycat.
In the event that a User or visitor wishes to set up a hyperlink to the Rubycat Site, they will be responsible for contacting Rubycat’s legal and marketing department using this form in order to make their request to set up a hyperlink. Rubycat reserves the right to accept or refuse the creation of a hyperlink to the Site without having to justify its decision.
A hyperlink set up to point to to this Site must only direct to the home page, accessible at the following URL www.rubycat.eu, www.rubycat.eu, fr.rubycat.eu or de.rubycat.eu, subject to this link opening in a new window. In addition, the linking to a website to complete a search for information does not in any way mean that Rubycat acknowledges or accepts any responsibility for the content or use of such website.
4. Limitation of liability
Any content downloaded is at the User’s own risk and under the User’s sole responsibility. Consequently, Rubycat cannot be held liable for any damage suffered by the User’s terminal or any loss of data resulting from the download.
Links to other websites are provided for information purposes only and Rubycat cannot be held liable for their content or for the conditions of access and use.

6. Applicable law and jurisdiction
These Terms are governed by French law and any dispute or litigation that may arise from the interpretation, validity or performance thereof shall be subject to the exclusive jurisdiction of the courts within whose jurisdiction Rubycat’s registered office is situated. The reference language for the settlement of any disputes is French.
